In order to comply with Article 10 of Law 34/2002 of Services of the Information Society and Electronic Commerce and Articles 97 et seq. of Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, regarding distance contracting, we inform users of our data:

1. Object

The present terms and conditions are intended to regulate an on-demand bus model (hereinafter BAD) that allows the provision and operation of the most efficient proximity service to adapt it to the real needs of its customers, residents in different areas of Barcelona, as a mobility alternative, by means of their request through two channels:

A user shall be understood as a person who enters the system, either through the app or the telephone channel, to create an account and request the services offered (hereinafter, the «user»).

By accessing and using this application you acknowledge that you have read and understand these terms and conditions and agree to comply with them, as they establish a contractual relationship between the user and B4M.

B4M reserves the right to modify these terms and conditions at any time, as well as any other general or particular terms that may be applicable. The modifications made shall not affect, in any case, the services that have been performed prior to the approval of such modifications, which shall be governed in any case by the terms and conditions in force at the time of performing such services. It will be understood that the user consents to changes in the terms and conditions in case of accessing our system after they have occurred. In the event of essential modifications to the terms and conditions, the user will be expressly informed so that he/she can accept or reject them. In the event of rejection, the user will no longer be able to use the system.

It is the user’s responsibility to be aware of the terms and conditions in effect at the time of initiating the on-demand bus service request. Likewise, B4M reserves the right to suspend, interrupt or stop operating the application at any time.

In any case, in order to be able to contract with B4M, the user must have the necessary legal capacity to enter into contracts.

The document formalizing the contract that regulates the commercial relationship between B4M and each of the users will be archived by B4M, and may be consulted through our system, after authentication of the user with the means established in each case. This hard copy may also be requested from the customer service department provided for in these terms and conditions. 

2. User registration

2.1. Customer registration

To facilitate the services offered through the system and avoid having to ask customers for the same data each time they make a request, it is necessary to register as a user of the service.

All individuals over 14 years of age with legal capacity may register. In that sense, the following data will be requested: name and surname, telephone number and if the user requires access to the bus through a reserved space. In the case of the app, they may also optionally indicate their e-mail address.

At the end of the registration process, the system will confirm that the process has been successfully completed. The user registration can be done at any time and only once, it is free of charge and is not subject to any condition or consideration.

The user will be able to access with his/her identification through the means that, in each case, B4M enables to authenticate users. In his profile, the user will be able to find relevant information such as information related to previous services or manage his favorites, consisting of designating preferred zones and stops to facilitate the registration of his services.

To unsubscribe, the user can do it directly from your customer area in the app or through the telephone channel. Unsubscribing as a user will entail the deletion of your personal data, as well as the impossibility of making reservations in the future until you do not register again, in accordance with the provisions of the Privacy Policy.

3. System operation

3.1. Service object

This service consists of an urban transportation system in specific areas, and the routes may not be of any other nature or character.

B4M provides the user with such on-demand transportation service in urban areas in real time and service reservations in advance in time.

The user shall indicate the stop of origin and destination of his trip as well as the time and number of people who will travel with him and if ramp access is required.

B4M will schedule the pick-up and drop-off stop for the user and an estimated pick-up time will be indicated. In case of pre-booking, the day and time of pick-up will be indicated.

3.2. Service reservation

This service consists of the customer’s request for one or more seats on the bus at a specific time for a specific route. There are two types of reservations:

  • Immediate reservation of the service: the reservation is requested at the same time the request is being made.
  • Scheduled service reservation: the reservation is requested for a future time.

o In case of non-attendance of the client with such a reservation, B4M will automatically cancel the reservation at its discretion and notify the client.

After making the reservation, users will receive a reminder of the reservation. In this reminder, the customer will be informed of the time, as well as the origin and destination stops. In the same reminder, the customer will have the possibility to cancel the reservation.

3.2.1. No-show (no-show customer)

Whenever the client or any or all of the companions on the same reservation do not or do not end up showing up at the stop and time indicated and have not cancelled the reservation in advance, the non-appearance of the client who made the reservation will be considered a no-show.

However, it will not be considered a no-show when the reserved bus has been delayed with respect to the maximum time indicated in the pick-up interval informed to the client.

The bus driver of the reserved service will record in the corresponding application the client or companions attending the reservation.

Failure to do so will prevent the customer from participating in the rewards program described in point 4.4. 

3.3. Route modification

B4M is not obliged to represent the route that the vehicle will follow to take the customers from the point of arrival to the point of departure, as this route may be modified along the way.

Once the service has been requested by the user, he/she cannot modify at any time the route and the agreed pick-up and drop-off points. However, the user may cancel the requested service.

Likewise, once the user has been picked up («picked up»), the user may not request the driver to modify the itinerary. 

4. Rights and obligations of the user

4.1. User behavior

Once the request has been made by the user, he/she agrees to be at the pick-up point five minutes before the specified time. It is the responsibility of the user to visually identify the vehicle that will pick him/her up.

Once inside the vehicle, the user may not alter the driver’s attention under any circumstances while the vehicle is in motion.

The user shall at all times maintain a moderate tone of voice so as not to cause discomfort to other passengers who may share the ride with the user and his companions.

In the event that the user is not present at the pick-up point and at the detailed time, it releases B4M from the obligation to provide the requested service.

4.2. Prohibited uses

The user shall be solely responsible for any illegal or unauthorized access or use of the system. Prohibited uses include, but are not limited to, the following:

a. Disclosing, publishing, distributing or sharing images or photographs that include images or personal information of third parties without having obtained the required consent of their owners.

b. Use the system or any of B4M’s services in an illegal manner or in any other way that may undermine B4M’s image, damage, overload or harm the system, or endanger the physical safety or well-being of third parties.

c. Create a false identity, provide or use false data in the user’s account, make false representations, provide false information about yourself or others and your relationship with them.

d. Registering as a user in the name of another person or in any other way that involves the use of other people’s identities and, in particular, identity theft or identity fraud.

4.3. Rights and obligations of users in the provision of the service

The rules and regulations of use in terms of rights and obligations, as well as the coexistence between users in our transport and facilities, are included, among others, in the passenger regulations of the surface public transport services of the metropolitan transport entity published on the BUS4ME website.

4.4. Rewards program

All registered customers over 18 years of age may be part of a rewards program exclusive to the on-demand bus, whose purpose is to promote loyalty in the use of public transport. To access this program, customers must give their express consent to it from the Bus4me application.

The rewards will be of a cultural nature and will be delivered every two months. The following criteria will be used to determine the winning customers for these rewards:

  • Booking assistance. The client must not have had any no-shows during those two months.
  • Volume of bookings made. The customer must have made a minimum of 50 trips every two months.
  • Booking channel used. The booking channel used must have been the Bus4me app.

Bus4Me will give the reward to those customers who, fulfilling these three conditions, have made the highest number of trips with the on-demand bus, and a maximum of one hundred rewards will be given every two-month period.

Bus4Me will contact the customer through the consented contact channel to notify him/her that he/she has been selected among the rewarded customers and will agree on the delivery method.

Bus4Me reserves the right to modify or cancel the terms and conditions of this program at any time.

5. Liability and non-compliance

5.1. Previous information

These terms and conditions are freely and freely available to all users of the system.

Access to the service request process is completely free of charge, with no additional costs associated with it, apart from those associated with the user having an Internet connection or telephone operator.

The obligations between B4M and the user are understood to be perfected from the very moment the user completes the service request procedure by pressing the «Confirm» button in the app or by giving his/her agreement via telephone, and it is understood that following all the phases of the electronic contracting procedure and the inclusion of all the requested data implies, together with the ticking of the corresponding box at the time of user registration, the acceptance of these terms and conditions and its data protection policy, which will be a direct manifestation of the user’s willingness to accept them with his express consent.

5.2. False information

The user is solely responsible for the origin, ownership, completeness, content, truthfulness and accuracy of the information provided through the B4M application.

Likewise, B4M shall not be liable for misrepresentation of information regarding carriers’ permits when acting as a technology licensee for the provision of the service.

5.3. Service Cancellation and Withdrawal Policy

The user can cancel the service request well in advance before the pickup is effective through the customer area of the app or by phone.

The user is not entitled to the right of withdrawal once the request has been accepted by B4M and the execution of the requested service has begun.

5.4. Limitation of liability. Fortuitous causes or force majeure

B4M does not undertake to strictly comply with the pick-up and drop-off times indicated in the proposal, as these may be prevented by external elements (unforeseeable changes in urban traffic, strikes, traffic accidents, etc.) or due to force majeure.

5.5. Alterations of service

When any incident occurs on the bus or on its route that alters the normal operation of the line and, therefore, of the reservations made during this alteration, the user will be informed as soon as possible, as well as of the effects generated by such alterations in terms of possible cancellation of the service, modification of this or change in the operating model, so that the service will be transferred to a conventional line.

B4M shall not be liable for any damages or lost profits caused by these service disruptions. 

6. Applicable regulations

This electronic contract is entered into under Spanish law and specifically under the legal regime imposed by, among others, Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce, which transposes Directive 2000/31/EC of the European Parliament and of the Council, of June 8, 2002, on certain aspects of information society services, in particular electronic commerce in the internal market, on certain aspects of information society services, in particular electronic commerce in the internal market, and by Royal Legislative Decree 1/2007, of November 16, 2007, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

The entire contracting process shall be carried out in the language of the country in which B4M provides the service, unless it is possible that the user and B4M may agree to enter into the contract in another language.

The language of the contract will be in Catalan or Spanish. The present terms and conditions may be saved and reproduced at any time by the user who acquires a service through the options of his internet browser and must be accepted at the time of registration in the application or in case of an essential modification in the same.

7. Integrated fare system

This BaD service is part of the integrated fare system regulated by the Autoritat del Transport Metropolità (ATM).

9. Protection of personal data

B4M is deeply committed to complying with the personal data protection regulations and guarantees full compliance with the obligations set forth, as well as the implementation of the security measures set forth in the European Data Protection Regulation and the Spanish data protection regulations. 10. Cookies

In the application, the provider may use cookies (small information files that the server sends to the computer of the person accessing the page) to carry out certain functions that are considered essential for the proper functioning and display of the site. The cookies used are, in any case, of a temporary nature, with the sole purpose of making navigation more efficient, and disappear at the end of the user’s session. 11. Intellectual Property

B4M is the owner or, if applicable, has the corresponding licenses on the exploitation rights of intellectual property of the technological solution of the application, as well as all the contents offered therein, including, but not limited to, the platform itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content, and the services available through the same.

In no case shall it be understood that the access, navigation and use of the application by the user or the use, acquisition or contracting of products or services offered through the same implies a waiver, transmission, license or total or partial transfer of such rights by B4M. The user has the right to use the contents or services of the application within a strictly domestic scope and solely for the purpose of enjoying the services provided in accordance with this Legal Notice.

References to registered trademarks or trade names, or other distinctive signs, whether owned by B4M or third parties, imply a prohibition on their use without the consent of B4M or their legitimate owners. At no time, unless expressly stated otherwise, access, navigation or use of the application or its contents gives the user any right over distinctive signs included therein.

All intellectual and industrial property rights on the contents or services of the application are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of the contents included in the application, for public or commercial purposes, without the prior, express and written authorization of B4M or, where appropriate, of the owner of the corresponding rights.

Likewise, it is forbidden to remove or manipulate the copyright indications or other credits that identify the holders of the rights of the contents that the user finds in the application, as well as the technical protection devices, digital fingerprints or any protection mechanism or information incorporated to the contents offered in the application.

In the event that the user sends information of any kind to B4M through any of the channels provided for this purpose, the user represents, warrants and agrees that he/she has the right to do so freely, that such information does not infringe any intellectual or industrial property rights, trade secrets or any other rights of third parties, and that such information is not confidential or harmful to third parties.

The user acknowledges that he/she assumes responsibility and holds B4M harmless for any communication he/she provides personally or on his/her behalf, and such responsibility extends without restriction to the accuracy, legality, originality and ownership of the same.

If the user becomes aware of the existence of any content that is illicit, illegal, contrary to the law or that could involve an infringement of intellectual or industrial property rights, he/she must immediately notify B4M through the e-mail address ¿ so that it can proceed to the adoption of the appropriate measures.

Likewise, in the event that any user or third party considers that any of the contents of the application owned by B4M violates their intellectual or industrial property rights, as well as any other rights, they must send a communication to ¿ with the following information:

  • Identification data and means of contact of the claimant or his/her legal representative.
  • Documentation proving your status as the owner of the allegedly infringed rights.
  • Detailed account of the rights allegedly infringed by B4M, as well as their exact location within the application.
  • Express declaration by the claimant that the use of the contents has been made without the consent of the owner of the allegedly infringed rights.

12. Applicable law and jurisdiction

For any litigious matter related to the application, and provided that the legislation so permits, the Spanish legislation in force at the time of the litigation shall be applicable, and the courts and tribunals of Barcelona shall be competent for the resolution of all conflicts arising from or related to the use of this application, in the event that the parties are free to determine the jurisdiction that may be applicable to them.
